These Standard Terms and Conditions (T&Cs) govern your use of and purchases from orders placed online at www.simonerocha.com


The offers on the Simone Rocha website are directed exclusively at consumers who conclude the purchase for a purpose that cannot be attributed to their commercial or professional activity.


The www.simonerocha.com website offers Simone Rocha products (the “Products”) for sale.


1. Formation of contract and delivery of merchandise


1.1 By placing an order, you confirm that the purchase is made exclusively for private, non-commercial purposes.

1.2 For orders placed online at www.simonerocha.com, we enter into contracts in the English language only. When you place an order for a Product, your contract is with SR Studio 93 Limited, or, in the case of orders placed from Wooster Street, New York, your contract is with Simone Rocha Retail Limited.

1.3 By clicking “Buy Now”, you are placing a binding order for the items in your shopping cart. Once your order has been submitted, we will immediately send you an email confirmation of your order. A binding contract is formed upon receipt of our order confirmation. Please note that for orders placed using advance payment, dispatch will take place once we have received full payment of the purchase price and any applicable shipping costs. We therefore request that you transfer the purchase price immediately upon receiving the order confirmation.

1.4 You consent to the assignment of the seller's claims for payment of the purchase price to third parties where applicable. 

1.5 In certain circumstances, we may be unable to fulfil your order where products become unavailable due to stock discrepancies, supplier failure, or other inventory-related issues beyond our reasonable control. In such cases, we reserve the right to cancel the order in whole or in part. Where this occurs, we will notify you as soon as reasonably practicable and refund any payments made for the affected items in full, using the original payment method. You will not be charged for any items that cannot be supplied.

1.6 We are not obliged to source Products from alternative suppliers where stock is unavailable. This applies also to generic goods where only the type and characteristics of the Products are specified. We are obliged only to make deliveries from our available stock. Where we make deliveries of goods from our available stock, the goods provided will be consistent with the order made by you. We deliver worldwide. Where time periods are expressed in working days, we understand working days to mean all of the days between Monday and Friday inclusive, but not public holidays.

1.7 Delivery times are stated on each product detail page and are also displayed prior to completing your order.

1.8 Delivery shall be deemed complete, and responsibility for the Products passes to the Customer, once the order has been delivered to the delivery address provided at checkout and confirmed as delivered by the carrier. Carrier confirmation of delivery may include, where applicable, delivery scans, GPS location data, photographic evidence, or a signature.

1.9 From the point of confirmed delivery, the Company shall not be responsible for any loss, theft, or damage to the Products, except where required by applicable law. Where an order is shown as delivered by the carrier, the Customer may be required to cooperate with any reasonable investigation carried out by the Company and/or the carrier in relation to any claim of non-receipt.


2. Prices, shipping costs and express delivery


2.1 The prices stated in the offer at the time the order is placed shall apply. All prices are final prices (total amounts) and include UK value added tax (VAT) or other applicable local VAT at the statutory rate. The merchandise remains our property until full payment of the purchase price has been received.

2.2 We assume the cost of shipping for all orders delivered within the UK where the minimum basket value is £500, and within the US (excluding Hawaii and Alaska) where the minimum basket value is $600. Please note that this does not apply to any orders containing collaborative products with Crocs and/or Adidas. For UK deliveries below this threshold, a flat delivery charge of £15 will apply. For US deliveries below this threshold, a flat delivery charge of $15 will apply.

 

3. Payment


3.1 We generally accept the following payment methods: credit card, Google Pay, and Apple Pay. We reserve the right to refuse certain payment methods for a given order and to require alternative methods of payment. You are responsible for any costs associated with payment transactions.

3.2 In the case of credit card purchases, your card will be verified at checkout and charged once your order has been confirmed by our fulfilment team.

3.3 You consent to receiving invoices and credit notes exclusively in electronic form.


4. Promotional vouchers and their redemption


4.1 Promotional vouchers are vouchers that are not available for purchase but are issued as part of advertising or promotional campaigns. They are valid for a specified period of time.

4.2 Promotional vouchers may be redeemed once only per order and only within the specified validity period. Certain products may be excluded from promotional offers. Promotional vouchers cannot be used to purchase gift vouchers. Please note that a minimum order value may apply to the use of promotional vouchers.

4.3 The value of the merchandise must be equal to or exceed the value of the promotional voucher. If the voucher does not cover the full value of the merchandise, the remaining balance may be paid using any of the accepted payment methods. Promotional vouchers have no cash value, will not accrue interest, and cannot be redeemed for cash. Promotional vouchers will not be refunded, whether in full or in part, if all or any of the merchandise is returned.

4.4 Promotional vouchers can only be redeemed during the checkout process and cannot be applied retrospectively once an order has been completed. Promotional vouchers are non-transferable and may not be passed on to third parties. Unless expressly agreed otherwise, it is not permitted to combine multiple promotional vouchers in a single order.

4.5 If you used a promotional voucher when making your purchase and, as a result of revocation by you, the total value of your order is less than or equal to the value of the promotional voucher, we reserve the right to charge the original price for any merchandise retained.


5. Gift vouchers and their redemption


5.1 Gift vouchers are vouchers available for purchase. They cannot be used to purchase additional gift vouchers. If the value of a gift voucher does not cover the full amount of an order, the remaining balance may be paid using any of the accepted payment methods.

5.2 Gift vouchers can only be redeemed and credits applied prior to completing your order. The value of gift vouchers will not be paid out in cash, nor will it accrue interest.


6. Option to return merchandise up to 14 days after receipt


6.1 Without prejudice to your statutory rights, we offer you the option to return merchandise within 14 days of receipt.

6.2 If you are returning Products, you can return the Products in person to our store in Mount Street, London or Wooster St, New York. 

6.3 You are responsible for the shipping costs associated with returning any item. Return shipping fees are set at £15 for the UK, £20 for Europe, and £30 for ROW. With the exception of the UK and EU member countries, original shipping costs are non-refundable and will be deducted from your final refund amount.

6.4 Merchandise will be deemed returned within 14 days if it is dispatched within that period. This voluntary return option is subject to the condition that items are only worn or tried on as they would be in a physical store and are returned complete, intact, and undamaged, in their original packaging. Until the expiry of the statutory right of withdrawal period, the statutory provisions governing such right shall apply exclusively. This voluntary return option does not affect your statutory warranty rights, which remain fully applicable. The option to return merchandise does not apply to gift vouchers.

6.5 The voluntary 14-day return policy does not apply to sealed goods that have been unsealed after delivery where, for reasons of health protection or hygiene, they are not suitable for return.


7. Refunds


Any refunds are paid automatically to the account you used for payment. For payments on account and advance payment by funds transfer, the refund will be sent to the account from which the payment was made. If you paid by credit card, Google Pay, or Apple Pay, the refund will be sent to your credit card, Google Pay, or Apple Pay. If you used a gift voucher for your purchase, we will credit the relevant amount to your gift voucher account. Please note we reserve the right to refuse refunds where the returned merchandise does not meet the requirements set out in clause 6.

9. Statutory liability for defects and further information


9.1 Our liability for defects is governed by the applicable statutory provisions. If you experience any issues with your purchase or wish to make a complaint, please contact us using the details provided in Clause 8 above.

9.2 These Terms and Conditions are available to view on our website, simonerocha.com. You may also print or save a copy of this document using the standard functions of your web browser (for example, File > Save As). A PDF version of these Terms and Conditions is also available for download and storage. To view PDF files, you will need a compatible PDF reader, such as Adobe Reader, or similar software.

9.3 You may archive your order details by downloading these T&Cs and saving or printing the order summary displayed at the end of the online ordering process using your browser’s standard functions. Alternatively, you may retain the automatic order confirmation e-mail sent to your nominated e-mail address upon completion of your order. This confirmation includes your order details and a copy of these T&Cs and may be printed or saved using your e-mail programme.
